In Brazil the legal education begins between 1827/28 in Olinda/PE and São Paulo/SP where the first Schools of Law were established by the new Empire using as educational model the Coimbra Faculty of Law.

Nowadays the legal education consists in a 5-year-long course in which, afterwards, the scholar is granted a bachelor´s degree.

Therefore, it is considered part of the higher education, hence the educational system is regulated as: i) basic education – primary, middle anda high school; and ii) higher education: licentiate, bachelor and vocational ed.

The practice of law is conditioned upon admission to the bar of a particular state or other territorial jurisdiction (Ordem dos Advogados do Brasil – OAB

Public attorneys, public prossecutors and magistrates (judges) admission is made, mainly, through an entrance examination and a constitutional mandatory three years of legal experience. Starting from the second degree courts it is mandatory a 1/5 of its composition to be fulfilled with members of the lawyers/attorneys/barristers association and also from federal/state/labour processcutors (ministério público) regarding the court jurisdiction (it is not applied for electoral and military courts).

After achieving the bachelor´s degree of laws it is possible to follow an i) specialization or follow ii) academically (or both), in either case it is called postgraduation: i) lato sensu; or ii) stricto sensu; respectively.

A politician proposed a seat-belt law for dogs https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/a-politician-proposed-a-seat-belt-law-for-dogs/ https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/a-politician-proposed-a-seat-belt-law-for-dogs/#respond Tue, 24 Jan 2017 06:16:00 +0000 http://raratheme.com/preview/lawyer-landing-page-pro/?p=195 A seat belt, also known as a safety belt, is a vehicle safety device designed to secure the occupant of a vehicle against harmful movement that may result during a collision or a sudden stop. A seat belt functions to reduce the likelihood of death or serious injury in a traffic collision by reducing the force of secondary impacts with interior strike hazards, by keeping occupants positioned correctly for maximum effectiveness of the airbag (if equipped) and by preventing occupants being ejected from the vehicle in a crash or if the vehicle rolls over.

When in motion, the driver and passengers are travelling at the same speed as the car. If the car suddenly stops or crashes, the driver and passengers continue at the same speed the car was going before it stopped. A seatbelt applies an opposing force to the driver and passengers to prevent them from falling out or making contact with the interior of the car. Seatbelts are considered as Primary Restraint Systems (PRS), because of their vital role in occupant safety.
An analysis conducted in the United States in 1984 compared a variety of seat belt types alone and in combination with air bags.

The range of fatality reduction for front seat passengers was broad, from 20% to 55%, as was the range of major injury, from 25% to 60%. More recently, the CDC has summarized this data by stating «seat belts reduce serious crash-related injuries and deaths by about half.»Most seatbelt malfunctions are as a result of there being too much slack in the seatbelt at the time of the accident.

Case Wants Law Strengthened https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/03/24/case-wants-law-strengthened/ https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/03/24/case-wants-law-strengthened/#comments Fri, 24 Mar 2017 05:39:55 +0000 http://raratheme.com/preview/lawyer-landing-page-pro/?p=179 Law is a system of rules that are created and enforced through social or governmental institutions to regulate behavior. Law as a system helps regulate and ensure that a community show respect, and equality amongst themselves. State-enforced laws can be made by a collective legislature or by a single legislator, resulting in statutes, by the executive through decrees and regulations, or established by judges through precedent, normally in common law jurisdictions. Private individuals can create legally binding contracts, including arbitration agreements that may elect to accept alternative arbitration to the normal court process. The formation of laws themselves may be influenced by a constitution, written or tacit, and the rights encoded therein. The law shapes politics, economics, history and society in various ways and serves as a mediator of relations between people.

A general distinction can be made between (a) civil law jurisdictions (including Catholic canon law and socialist law), in which the legislature or other central body codifies and consolidates their laws, and (b) common law systems, where judge-made precedent is accepted as binding law. Historically, religious laws played a significant role even in settling of secular matters, which is still the case in some religious communities, particularly Jewish, and some countries, particularly Islamic. Islamic Sharia law is the world’s most widely used religious law.

The adjudication of the law is generally divided into two main areas referred to as (i) Criminal law and (ii) Civil law. Criminal law deals with conduct that is considered harmful to social order and in which the guilty party may be imprisoned or fined. Civil law (not to be confused with civil law jurisdictions above) deals with the resolution of lawsuits (disputes) between individuals or organizations.

Court to rule on gun law https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/court-to-rule-on-gun-law/ https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/court-to-rule-on-gun-law/#respond Tue, 24 Jan 2017 05:55:57 +0000 http://raratheme.com/preview/lawyer-landing-page-pro/?p=186 The right to keep and bear arms is guaranteed by the Second Amendment to the United States Constitution. Most States’ constitutions also have an enumeration of the right to keep and bear arms, with most explicitly affirming that it is a right retained by each person or individual.

Persons are generally prohibited from purchasing a firearm if:

they are under indictment for a felony, or any crime which could result in more than a year in prison.
they have been convicted of a felony, or any other crime for which they could have been sentenced to more than a year in prison.

  • they are a fugitive from justice.
they are an unlawful user of, or addicted to, controlled substances, including marijuana.
they have been adjudicated mentally defective.
they have been discharged from the Armed Forces under dishonorable conditions.
they have been convicted of a misdemeanor crime of domestic violence.
they have renounced their United States citizenship.

The carrying of weapons, either openly or concealed, is regulated by the states. The laws regarding carrying weapons have been changing rapidly over the past ten years. As of 2016, most states grant licenses to carry handguns on a Shall-Issue basis to qualified applicants. A few states leave the issuance of carry permits to the discretion of issuing authorities (called may-issue), while eleven states allow the carrying of firearms in a concealed manner without a permit (called Constitutional carry). Twenty-six states allow for open carrying of handguns without a permit while, in general, twenty states require a permit to do so and four states plus Washington D.C. ban open carry of handguns.

In 2008, in District of Columbia v. Heller, the Supreme Court held that the right to bear arms was an individual right. In 2010, in McDonald v. Chicago, the Supreme Court extended the Heller ruling to the states. In 2012, in Illinois, Moore v. Madigan sought to overturn the state’s ban on carrying concealed weapons. The district court dismissed the case, but the Seventh Circuit Court of Appeals ruled the ban on carrying firearms as unconstitutional. The state legislature passed a bill allowing concealed weapons shortly thereafter.

As of 2015, California’s laws regarding concealed weapons are being challenged in court. In Peruta v. San Diego County, the court said that the state’s strict «may issue» rules were unconstitutional and greatly reduced their reach. The ruling is stayed pending appeal. The final ruling declared that concealed carry is not a constitutionally protected right, which implicates open carry as constitutionally protected, despite California’s ban on open carry in any county with a population greater than 200,000. Additional lawsuits are pending to clarify the constitutionality of bans on open carry.

Homelessness Reduction Bill to become law https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/homelessness-reduction-bill-to-become-law/ https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/homelessness-reduction-bill-to-become-law/#respond Tue, 24 Jan 2017 06:01:05 +0000 http://raratheme.com/preview/lawyer-landing-page-pro/?p=189 Homelessness is the condition of people without a permanent dwelling, such as a house or apartment. People who are homeless are most often unable to acquire and maintain regular, safe, secure and adequate housing. The legal definition of homeless varies from country to country, or among different jurisdictions in the same country or region.

The term homeless may also include people whose primary night-time residence is in a homeless shelter, a domestic violence shelter, long-term residence in a motel, a vehicle, squatting, cardboard boxes, a tent city, tarpaulins, shanty town structures made of discarded building materials or other ad hoc housing situations.

According to the UK homelessness charity Crisis, a home is not just a physical space: it also provides roots, identity, security, a sense of belonging and a place of emotional wellbeing. American government homeless enumeration studies also include people who sleep in a public or private place not designed for use as a regular sleeping accommodation for human beings. There are a number of organizations who provide help for the homeless.

In 2005, an estimated 100 million (1 in 65) people worldwide were homeless, and as many as 1 billion people live as squatters, refugees or in temporary shelter, all lacking adequate housing. In Western countries, the large majority of homeless are men (75–80%), with single males particularly overrepresented.

Law allows young as 13 to get married https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/law-allows-young-as-13-to-get-married/ https://desdeelembarazohastalaprimerasonrisa.giselaramos.com.mx/2017/01/24/law-allows-young-as-13-to-get-married/#respond Tue, 24 Jan 2017 06:32:02 +0000 http://raratheme.com/preview/lawyer-landing-page-pro/?p=198 Child marriage is defined by global organizations as a formal marriage or informal union entered into by an individual before reaching the age of 18.The legally prescribed marriageable age in some jurisdictions is below 18 years, especially in the case of girls; and even when the age is set at 18 years, many jurisdictions permit earlier marriage with parental consent or in special circumstances, such as teenage pregnancy. In certain countries, even when the legal marriage age is 18, cultural traditions take priority over legislative law.]Child marriage affects both boys and girls, though the overwhelming majority of those affected are girls, most of whom are in poor socioeconomic situations.

Child marriage is related to child betrothal, and it includes civil cohabitation and court approved early marriages after teenage pregnancy. In many cases, only one marriage-partner is a child, usually the female. Causes of child marriages include poverty, bride price, dowry, cultural traditions, laws that allow child marriages, religious and social pressures, regional customs, fear of remaining unmarried, illiteracy, and perceived inability of women to work for money.

Child marriages were common throughout history for a variety of reasons, including poverty, insecurity, as well as for political and financial reasons. Today, child marriage is still fairly widespread in developing countries, such as parts of Africa, South Asia,Southeast Asia, West Asia,Latin America, and Oceania. The incidence of child marriage has been falling in most parts of the world. The countries with the highest observed rates of child marriages below the age of 18 are Niger, Chad, Mali, Bangladesh, Guinea and the Central African Republic, with a rate above 60%.Niger, Chad, Bangladesh, Mali and Ethiopia were the countries with child marriage rates greater than 20% below the age of 15, according to 2003-2009 surveys.
